Tax Advisory ~ 6 weeks

Challenge

A family-owned manufacturing company received a revised assessment from LHDN following a field audit. The additional tax and penalties raised amounted to over MYR 180,000. The company's directors were unfamiliar with the objection process and uncertain whether the assessment was well-founded.

Approach

Greymantle reviewed the assessment in detail, identified two areas where the LHDN calculation appeared incorrect, and prepared a formal objection letter supported by the relevant documentation. We also advised on the payment position during objection proceedings to avoid unnecessary penalties accruing.

Outcome

The revised assessment was reduced to approximately MYR 47,000 after the objection was reviewed by the Board. The matter concluded without formal appeal proceedings. The client also requested a follow-up review of their accounting and tax practices to reduce exposure in future years.

Insurance Claims ~ 10 weeks

Challenge

A commercial property owner made a claim under a business interruption policy following flood damage. The insurer offered a settlement covering only direct physical damage, excluding loss of revenue during the period the premises were unusable. The policyholder believed the full loss was covered under the policy terms.

Approach

Greymantle reviewed the policy wording in detail and concluded the business interruption coverage did extend to the claimed loss. A formal written response to the insurer set out the basis for this interpretation, supported by the policy schedule and relevant documentation of the revenue impact.

Outcome

Following two rounds of negotiation, the insurer agreed to extend the settlement to include three months of business interruption loss, increasing the total recovery by approximately MYR 95,000. The matter was resolved without referral to the Financial Mediation Bureau or court proceedings.

Maritime Law ~ 8 weeks

Challenge

A freight forwarder sought advice on recovering losses from a carrier following significant damage to a container shipment arriving at Port Klang. The carrier disputed liability under the bill of lading and argued that the damage had occurred prior to loading. The client faced a tight limitation period.

Approach

Given the time pressure, Greymantle moved quickly to assess the applicable convention, review the bill of lading terms, and commission a written summary of the survey evidence. A letter of claim was issued to the carrier and their P&I Club within the first week. Negotiations followed over the subsequent weeks.

Outcome

The P&I Club agreed to a settlement at approximately 80% of the claimed loss, acknowledging that liability for the majority of the damage rested with the carrier. The matter was resolved by commercial settlement, avoiding the need for admiralty court proceedings. Limitation was preserved throughout.
